Biography

Justin M. Kirk is an Associate at Oak Tree Law, where he works with clients who have problems with debt or are facing foreclosure. Prior to working at Oak Tree Law, Mr. Kirk worked at several law firms, including his own practice, handling Chapter 7 and 13 bankruptcy matters and appearing at bankruptcy hearings before the U. S. Bankruptcy Court, Central District of California and before the U.S. Department of Justice, Office of the Trustee.

Justin’s experience in the bankruptcy field helps him to ensure that he is choosing the right option for each individual client. These options include determining how bankruptcy might be used to either discharge or reorganize individuals’ debts while also protecting their assets and income; compiling and submitting requires for mortgage assistance for homeowners; negotiating with banks and other lenders to work out payment plans; and determining when litigation would be appropriate and useful in the pursuit of a loan modification.

What Justin enjoys most about working at Oak Tree Law is the opportunity to help as many people as possible to solve their debt-related problems by matching them with the right solution. He believes that bankruptcy is a solution that can help a lot of people facing unsustainable levels of debt to get a new start. He enjoys working with his clients to discuss their options and to develop solutions that will work for them, whether those solutions include bankruptcy, negotiating a modification of a home loan with a bank, or litigation. The solution for each individual client is different, but the ultimate goal is the same: to protect the client’s income and assets as much as possible, wherever it is feasible, to help them to stay in their homes as long as possible.

Justin says, “I get to meet people from all different walks of life and help solve real financial burdens which they cannot solve themselves. I help people stay in their homes and avoid financial ruin. Many of my clients are dealing with unmanageable levels of stress that has affected their health and relationships. I may be the first person they speak to about these problems, and I am glad that I can be there for them to unload those burdens and help them to find a path forward with concrete steps that they can take to resolve the problem. But it isn’t a one-way street; I gain something from my clients as well. We each learn from each other.”

Mr. Kirk was admitted to the practice of law in the State of California in 2009 and is also admitted to the United States District Court for the Central District of California. He received his Juris Doctor degree from Lewis & Clark Law School in 2008, with a certificate in Business Law. While at school, he was the Notes and Comments editor of the Environmental Law Review, and was a semifinalist in UC Davis’ Asylum and Refugee Moot Court Competition. He received his undergraduate degree, a Bachelor of Arts in Interdisciplinary Studies, from the University of California, Berkeley in 2002.
